The announcement was made by Lucian Bode, the current Minister of the Interior, former Minister of Transport and Communications in 2020. "Thus, we will have a solid tool to reduce the risks to national security and defense," said Lucian Bode.
The project provides for measures that could block the access of some flagship companies in China to tenders for 5G equipment in Romania. After approval by the Government, the law goes to Parliament.
Authorization from the Prime Minister, opinion from CSAT
According to the project, the manufacturers of telecom equipment must receive an authorization in order to be able to provide installations to the telephone operators in Romania.
The respective authorization is granted by the Prime Minister of Romania, based on an opinion of the Supreme Council of National Defense (CSAT).
According to the draft, this opinion may be refused in order to avoid risks that may arise from:
Main target: Huawei, which is the world's largest supplier of such equipment.
Memorandum with the United States
The law comes to implement the "Huawei Memorandum", signed by Romania with the USA.
Consumers may still be able to buy Huawei smartphones, tablets or laptops, but telecom operators may be prevented from buying equipment from the Chinese group.
After the approval of the law, ANCOM - the communications authority - will be able to launch the tender for 5G licenses.
In a statement last summer, the company said it had invested more than one billion euros in Romania, contributed more than 6,300 jobs and spent almost 500 million euros on acquisitions.
The US accuses Huawei of spying for China
The company is accused of spying for China, as well as ZTE, the other major telecom equipment manufacturer in Asia.
The United States accuses Huawei of being controlled by Beijing authorities.
Huawei denies the allegations and says it is a private enterprise.
Established by a military man
The company was founded by a former military man, Ren Zhengfei, and the United States has placed Huawei on a list of companies controlled by the Chinese military. Ren Zhengfei owns only 1.42% of the company's shares, and the shareholding is opaque.
There is also a law in China that requires companies in that country to assist the judiciary.
Huawei accuses the US of wanting to eliminate it from 5G competition just to preserve its digital hegemony.
Several incidents have been linked to Huawei over time. Vodafone discovered in Italy that Huawei had access to the routers it had previously delivered.
The US also accuses Huawei of stealing trade secrets.
The founder's daughter, accused of fraud
The daughter of Huawei founder Meng Wanzhou, who is also the company's chief financial officer, was arrested in Canada in 2018 and is fighting in court to avoid extradition to the United States.
She is accused of setting up a mechanism through which Huawei delivered equipment to Iran, although the state is under sanctions.
Huawei has received at least $ 75 billion in state aid, subsidies and tax cuts from the Chinese state, according to an analysis conducted in late 2019 by the Wall Street Journal.
What other countries have banned Huawei
In addition to the United States, the United Kingdom and France have decided to ban Huawei's 5G devices in their networks.
Other states, such as Japan, Australia and New Zealand, have also taken action.
In December, Italy opposed a deal between Fastweb and Huawei, according to Reuters.
