The Chisinau City Hall risks being harmed with 7.6 million lei, in another resonance file, with the involvement of the company "Offer Plus" S.R.L.Information in this regard was presented by the mayor of the capital, Ion Ceban
SRL "Offer Plus" submitted the application in the Balti Court (headquarters) regarding the request from the account of the Chisinau City Hall and to the Municipal Council, in the amount of 3,750,000 lei, as a debt and 3,939,534 lei as delayed delay.
By the decision of the Balti Court (headquarters) of July 16, 2021, the request of the company "Offer Plus" S.R.L. was fully admitted.
More serious is that the court ordered additionally and the collection of delay in the amount of 3,939,534 lei, contrary to the legislation in force without arguing the soundness of the pronounced solution, says the mayor of the Capital.
The file is an old one, still on January 16, 2006, the company "Grandteam" LLC (a company headquarters), acted in the court S.C. "Sintec Gaz" and the Chisinau Municipal Council, requesting the amount of 3,750.000 lei.
The company "Offer Plus" S.R.L., as an accessory intervener, participated in the process.
CSJ issued an irrevocable decision in 2006
As a purpose of the respective trial, by the irrevocable decision of the supreme justice of May 18, 2006, it was ordered the amount of 3,750,000 lei only from the account of the company "Sintec Gaz" S.R.L., the Iarcărinta regarding the collection from the account of the Municipal Council of the amount of 3,750.000 lei cataloging as a demand.
Later, by the conclusion of the Economic Court of Appeal of April 1, 2008, the company S.R.L.The "offer plus", in the capacity of successor, has been submitted in the procedural rights with the company "Granteam" LLC, including in law regarding the collection of 3,750,000 lei from the company "Sintec Gaz" S.R.L.
Two different court decisions
"Today, in the created situation, the company" Offer Plus "S.R.L. will have two decisions pronounced by courts, regarding the collection of one and the same amount of 3,750,000 lei, in a case from the company" SintecGaz "S.R.L.(having the decision of the Supreme Court of Justice of May 18, 2006), and the other from the Chisinau City Hall and the Municipalichişinau Council (depicting the decision of the Bălți Court (headquarters) from July 16, 2021) ”, the mayor says.
However, taking into account the motivated part of the decision of the Supreme Dejustion Court of May 18, 2006, it turns out that the City Hall of Chisinau Municipality does not pay the amount of 3,750,000 lei, the reselling requirement being rejected as an unfounded one.
The court decision in Balti was challenged
The City Hall of Chisinau challenged the decision of the Court (headquarters) of July 16, 2021, the case to be examined by the Bălți appeal, in the near time.
In addition, the City Hall of Chisinau has noticed several state institutions about the created situation, in the sense of the respective monitoring, taking the measures that are required, within the limits of their communities.
